We are family of four and have the following status
Self - Adjustment of Status (AOS - 485 filed in July'07), AP, EAD and a valid H1 (renewed recently)
Spouse - AOS 485 (filed in July'07), AP, EAD, H4 expired end of April 2010
Son 14 yrs. old - AOS 485 (filed in July'07), AP, H4 expired end of April 2010
Daughter - 11 yrs old - AOS 485 (filed in July'07), AP, H4 expired end of April 2010
Does my family have valid status? Specially my kids since they don't have EAD. Shall I renew their H4 for valid status? I was in the impression that if 485 is filed then there is no need to renew H4. Please advice me. I am totally confused.

LCA for people who work from home
I work from home and one week a month i go to my consulting company office
I live in Texas and company is in NJ .
my question is should the lca be filed from nj where the company is
or should it be filed from Tx where I live and work from home

C. List your present and past membership in or affilation with every organization , association, fund....
I am currently a member of the below listed service oriented/not for profit organizations.
1.http://www.indiateam.org/
2.http://www.helpsavelife.org/
3.http://www.albanytamilsangam.org/
Do I need to tell about them?

Nothing unusual...infact just a tiny tip of an iceberg. Family based immigration including marriage constitute close to 85-90% of US new immigrants. Other avenues being tightened in recent years, we are sure to see more and more. In fact in recent years I have seen many H1Bs/F1 marrying USC.
For every case being busted, there are many many undetected cases. It is called legal arbitrage, with other areas being tightened amd under attack and marriage based being relatively untouched, it is a matter of time that one will increase.

You are already counted in the quota. So it is just transfer. But for transfer need recent paystubs. Consult a lawyer how to handle this. Definitly you no need to wait for April 1 st quota for new H1B.

New I 140 possible in case of appeal pending on old I 140 rejection
I'VE A QUESTION REGARDING I-140 case on appeal. The original approved PERM labor certification is in that case. In order to file new I140 Whether, I need to ask USCIS to withdraw that case and use my approved labor certification for this new I-140. But I am not sure how to accomplish that. Let me know if you have any helpful info.

If your petition has been physically "Mailed" to the Atlanta Service center . Do they give you a tracking number . Can such cases be viewed online on the website http://www.plc.doleta.gov ? How much time does the Atlanta service center take to acknowledge the reciept of such application ?
