Hi Everyone,
I have completed my 6yrs H1-B and currently have 1yr h1-B extension until Jan, 2010. However, my PERM application for Green card was filed on Jan 2008 and is still on hold.
Given the above case can I still transfer my H1-B to a new employer with 3yr extension? I have heard that after the 6yr period H1-B is over sometimes there are cases where 3-yr or new 6yr period H1-B are issued. Can someone advice me whats the best scenario for me?

I was keep observing the PERM approval rate trend for the past one year. Approval rate is very slow. But it is suddently jumped since last month. Looks like it is a good time to start filing another labor. I am in the same boat. Trying for a new employer for EB2.

Hi All,
My employer has filed for ETA 9089 and it is approved. I am paying for the green card processing. Before applying for I-140 he asked me to sign a memorandum which states that I am bearing the complete expenses of the process (filing fees of I-140 , I-485 and $500 extra) . It also states that I need to be with the company for 6 months from the time green card is approved. In case I leave the company prior to 6 months for whatsoever reason, I need to pay $15000 as damaging charges to company.
He says that signing this memorandum is mandatory otherwise he will not file I-140.
My questions is , Is it legal to bind an employee to these conditions and ask processing fee to file Green card ? Also are these documents valid from legal perspective ?
Please let me know your thoughts on this. Appreciate it.

Hi guys,
I got as well the unlucky audit like almost 80% of the people filing for a PERM.
My L1 visa is expiring on May 14th and the PERM audit reply was on Jan 28th and based on the current cases pending, I will hearing back from Atlanta sometimes between July-August.
I also applied for the H1-B and get approved but it is starting on Oct-1st,2008
1.- Can I stay "out-of-status" based on the INA 245 that "allow us to stay up to 180 days because change of status in process"?
2.- This changes of status process is valid only when you file the I-485 or for anyone already starting GC process like PERM in process?
3.- If I need to come back to my country and get the H1-B stamped, Do I loose the current PERM even if it get aproved or can I use the same PERM once aproved and apply for I-140/I-1485 concurrently (because EB-2 category) no matter I 'll have a different Visa H1-B instead of L1-B stated in the PERM?

Fedex does not renew the H1B visa even if their present employees are in H1B visa. this is the policy they are following nowadays.

I have a question regarding location change with same employer. I have labor approved on EB2 India with PD 01/2005. I am employed with a big health care firm which has various locations in the region. I'd like to move to another location which is 30 miles away from my present site. I140 is pending with the same employer. I have also posed this question to my lawyer but appreciate greatly if anyone knows answer to this. Will this affect my GC?

If I move to a company with the exact same job description,
a) Whom do I need to inform, with regards to , AC21 portability clause
b) Who will check if the job is in the exact (same/similar) field
c)Possibility that there will be RFE after I-485?
d)What if the GC sponsoring company is not helpful after I move to a different company. How is this going to affect?
I need to weigh in the costs associated with countering a RFE and the increased salary due to job change.
Let me know your opinion.

Call Customer Service. Phone no. is provided on any of your recipt notices. These is an option for typos on the document, when you call them. Tell them and they will open a Service Request, and update your name either when you go for fingerprinting or immedately. Mostly, they will open service request. You should also get an email confirming the Request made by you within few days (When I called for my typo, they said witin 45days, but got the mail within 15 days). Take that email with you if you get it before fingerprinting.

Which comes first.....card production ordered or approval sent? Are there cases when they don't update the status online with "approval sent" yet you have physically received the EAD cards. How long does it take to physically receive the cards from the date the status changed to card production ordered?

With predictions that the H1B cap will be reached any day now, employers and employees are rushing to beat the cap. United States Citizenship and Immigration Services (USCIS) announced that, as of December 4th, it had received approximately 61,100 H-1B petitions counting toward the congressionally-mandated 65,000 limit. Additionally, USCIS has approved sufficient H-1B petitions for foreign nationals with advanced degrees to meet the exemption of 20,000 from the fiscal year 2010 cap. Any H-1B petition filed on behalf of a foreign national with an advanced degree will now count toward the general H-1B cap of 65,000.
So why are they still accepting cases? Well not all filed H1B petitions will be approved so the final count will not be known until USCIS will clear all denials. We will keep you posted.
