    Has anyone seen this pattern before for any service center? A "processing times" entry missing? Could this be just an accident, or are they sending the I-140's to another service center? This could mean a LOT to people who sent their I-140's and I-485's concurrently to TSC.

    Hi everyone, I applied for H1B last year and my employer said my application was not selected in lottery. This year a different employer is applying for my H1 and the lawyer today told me that I already have an approval and gave me a receipt no. When I checked its status online, its - 'Approval notice sent on 29th August 2007'.

    I wonder how this lawyer is saying this is my approval, eventhough I was told by my employer last year that I didn't made through lottery. And now this lawyer is asking for the copy of that approval which I am not at all aware of. If I knew I already have the approval I wouldn't be applying again this year.

    How did this lawyer found out about my approval receipt? Is there a provision for them to check? Will it be illegal if my application goes again, with an existing approval. I have never been to USA.

    Please suggest, what should I do.

    Hello Folks,

    My H1b is 2 and half years old. I transferred it once, i.e in 2007

    My brother has got GC a year ago and started his own company. I am planning to transfer it to him.

    I have these following questions.
    1. What is the risk on transferring my H1 to a new/small company in this recession period, and the employee strength is just one (my brother).
    2. Is it ok to transfer more than one time in short period(i.e in 2 years span)?
    3. Also, is it acceptable to stay outside US for couple of months on H1 status with out payroll? Will that be a problem at POE when i return to US?
    4) Right now i am out of the project (on bench), so will that be any risk of my H1 transfer getting denied ?

    Hello Gurus,
    Can we apply for H1 if our I-485 is pending while the current status is L1.

    The reason I am asking is I-485 is itself a COS and if we apply H1 while on L1 it is again an COS petition from L1 to H1. So what happens to the I-485 application?:confused:

    Will there be any impact or no impact at all?:mad:

    Is there an option to apply without asking for COS when applying H1 with the current status as L1.:confused:

    Please help with your views....

    Last year, employers submitted so many H-1B petitions, the USCIS had to pick the winners by lottery. This year, seven months after the opening of the filing season that started on April 1st, the H-1B cap has yet to be reached. However, the numbers may not last long. During the first week of April, the USCIS received almost enough H-1B petitions to fill the 20,000 cap for persons with advanced degrees, but only 43,000 petitions against the 65,000 general cap. Over four months later, only 2,000 more H-1B petitions had been approved. Why so few? It's the economy, stupid! But...

    Anyone has any idea?

    I have approved I140 (EB3, PD:Nov'04) from previous employer; after getting my MBA (Jun'06), I have changed the job and my job description has also changed. New employer will file the labor after 3 months (HR Policy)..I have good relations with previous employer, they are ready to file I485. Is it possible to file I485(previous employer), while I am working with new employer?

    I am not sure but I came to know (not reliable source), that it is possible to file I485(previous employer) and during the interview, I can submit a support letter from the new employer. is this correct?

    Requesting your help..so near...but so far!!!!!

    HI All,

    I have 3 questions

    1)what should be the time period between the Job switch from one employer to another after 6 months of filing of I-485.(AC-21)

    2)Is it required to be employed until i get my actual GC ?

    3) I am in the period of AC-21 (i.e 180 days completed after my I-485 filing)
    If I marry to GC holder . Do i still have to maintain my independent status of I-485 or i can be given some status because of marrying to him..

    Can a person join a new employer for doing his LC, based on already sent out ads ???

    what they are telling me is that the ad is very general for EB2 which was sent out even before one joined the company. so my question would be that can a person go ahead and use the already sent out ads or one should raise some red falgs, not to go for it ???

    Both cards should arrive to the address that CIS has on file for the couple. The wife's departure from the US should not affect this. However, she needs to have the card to return to the US, ideally. Hopefully husband can send her the card.

    My job requirement states MS and atleast 3 years experience. I have only 2 years and 9 months experience. what are the chances for my I 140 approval.
