Maybe the 60 Minutes story from a few months ago is making a difference. DHS finally agreed today to show some humanity and not proceed for two year with deporting widows and widowers of US citizens (often American soldiers who die in combat) who only were denied green cards because their spouses died before USCIS could finish processing their cases. The courts have not been consistent in their rulings and it is going to take the US Supreme Court settling the matter (or DHS backing down). Hopefully, this marks the end of USCIS' rabid pursuit of a population that deserves...

Looks like it will be a long wait for many of us to get green card. Was wondering if there are any state/federal college plans or something similar which allows non-immigrants to participate. If not, are there any equivalent private plans available. I'm sure any inputs will help.

For years, open-government groups have fought to make the reports public, and for years, many lawmakers have kept them under wraps. Or so they thought.
By insisting on secrecy, Congress instead created a bootleg market for the research. Every day, a small Texas company compiles the reports and sells them to lobbyists, lawyers and others who pay thousands of dollars for a peek at the reports and what they say about the congressional agenda. And it's all legal.
"How I get them is my trade secret . . . but I get them all," said Walt Seager, who digs up the reports for Gallery Watch, a legislative tracking service.
The Congressional Research Service (CRS) was established in 1914 as Congress's supplier of nonpartisan research and analysis. Its reports are neither classified nor copyrighted, but they've long been the exclusive property of lawmakers, who distribute them as they see fit. Taxpayers supply the agency's $100 million annual budget, inspiring open-government groups and some lawmakers, including Sens. John McCain (R-Ariz.) and Patrick J. Leahy (D-Vt.) to push for public release of CRS reports.
Aftergood and others have fought back by posting every CRS report they can find on their Web sites. But watchdog groups have released only about 10 percent of the total, not enough to reveal the patterns that suggest what Congress might do next.
Subscribers to Gallery Watch pay about $4,000 a year to get all the CRS reports, online and searchable, delivered weekly.
At a recent meeting for potential customers, Riendeau explained that clients scan the reports for intelligence "kind of how the CIA operates," by spotting the political trends suggested by their contents and timing, he said. About a year ago, lawmakers made a flurry of requests for CRS reports related to North Korean counterfeiting of U.S. currency; not until months later, when the Treasury Department cracked down on North Korea, did the issue appear in newspapers.

Hi Friends,
My AP is expering next month(NOV), I don't have any travel plans for next 1 year. i'm planing to apply in 2010 not now.
do i need to apply for extesion for evey year, if don't need also?

There is no AP renewal. You can apply AP later if you are not planning to travel. But AP is for travel during emergencies. It takes time to get the AP approval. Hence people keep it current all the time.

No, Only a Green Card holder in a Legal Permanment Resident. All other Visa Holder or Pending AOS is not LRP yet, but that should not cause an issue with your loan application. They might ask additional documents to validate you status here, but should be okay.

Does any one knows why EB2 India is not approving in comparison to 2006.
As my understanding that USCIS should process application in FIFO and PD.
My PD is Feb 2005 and when I talked to CS he told me that everything is cleared and my case should be approved .
He told me to call after 68 days ( don't know why) if my case is not approved till then.I am seeing peoples with 2006 PD are getting there GC .

Immigration lawmakers try to pick winners and losers. The problem is that just like a broken analog clock with its hands frozen in place, the timing is mostly wrong. This brings me to one of my pet peeves. It bothers me that the immigration laws and agency regulations favor some fields of study and disfavor others. Why for example are students in the STEM subjects(Science, Technology, Engineering and Math) given 27 months of "optional practical training" -- a euphemism for work permission --- while liberal arts students get only 12 months? I'm planning to file GC for my parents (along with adjustment of status) when they visit me in a couple of months.
I'd a couple of questions regarding the birth certificate requirement.
They were born in Undivided India (before Aug 1947) and their place of birth is now in Pakistan. They migrated to India and have lived in a suburb of Mumbai most of their lives.
- I am planning to get affidavit of birth proving their place and DOB. Does this affidavit need to be on a Indian Govt issued stamp paper to make it look official?
- How do I get around Non availability or No record of the birth certificate requirement as their place of birth is in Pakistan. Can the municipal authorities of Mumbai issue this document?
Can somebody please help by sharing their experience if they are/were in a similar situation.

Hello:
I am on L1A at present and my full 7 year term is expiring in DEC-2012. My company could not file EB1-Int'l Executive or manager due to ownership changes etc. But they are considering EB2 and I was told that it will be risky as I would be required to convert to H1B before that and I would lose one year of stay.
Can someone advise whether my company can apply for extension of my L1A beyond the 7 years, if it files for EB2 and would be pending for approval, instead of going through the issue of converting to H1B?
