I am a July filer and have the option of working for a reputable company as expert consultant for 6 months (initial offer). Yates memo indicates that self-employment is possible. Here is my question: Do we need to register a company to be considered self-employed? As a consultant you may not have a customer for while. Isn't it better to register a company if you want to claim self employment? What are the pros and cons of registering a company?

I am in my 8th year H1-B( came in 1999 first to USA) extension based on pending I-140 & I-485 , I have my 2nd EAD in So now my question is
Is it safe for me to switch to EAD or keep extending my H1-B till I have my I-140 and 485 is approved? My I-140 has been pending for the last 2 yrs because of the FBI security checks etc. Since my H1-B extension beyond 6 yrs is based on pending I-140 and I-485 does it really make sense to keep extending it since I have to pay from my end my employer doesnt pay for it or is it better to be on EAD?

I am on H1 B visa. I want to change my last name. If any H1 B visa holder has changed his/her name in US, please let me know the procedure and probelms encountered during the process.

Which service center did you apply? Was it renewal or first time application. My friend got it renewed from texas center in 57 days. Mine also pending for renewal in Nebraska center.

Hi,
My L1B visa & petition with Company A runs upto Sep this year.
I'm applying for H1B petition with company B this year.
my current Company A will try to go for L1B petition extension, so that I can continue being here beyond september.
My concern is if these 2 will clash with each other ?
One of my friends said that whichever petition gets approved latest - will be the one that holds good.
So if L1B extension gets approved after h1B, will that negate H1B ?
and vice-versa ..

I'm in the 8th year of H1-B, BEC priority date 04/2001, just got a notice that the case was closed ?? and the lawyer is working to reopen the case.
I have now a very good opportunity to work for another company, huge pay and benefits, a lot of pressure from this company to work for them.
Pls who can answer 2 small questions:
1. Do I have a chance to work for this company?
2. It makes a difference if I'm currently in NJ and this new company is in Utah - thinking that maybe they are not so many applicants in that state? Just for the LC processing speed?

I have a EB3 case from employer A, and an EB2 case as a future GC from employer B , and got the date ported from EB3 case to EB2 , got EAD and AP .Now I have started working for employer B on EAD, for the past 3 months, and now my contract might expire with the client and loose job, I have found an other job , but have to leave employer B, now my question is, can I file AC21 and leave my GC sponsoring company(employer B), or is it a very short time , and raise any doubts on being a "NO GOOD FAITH"case.Please help.All I 140's are approved.

I have one question about the online AR-11 form.
In the online AR 11 form there is one field called Port of entry and there is drop down box which has many items to select the port of entry. This drop down box has two items related to my port of entry.
MA- BOSTON
MA- LOGAN Airport
Are these really two different airports?
I entered US in the Boston Logan Airport (international airport). Which entry I need to select?

I Am planning to apply for my 10th Year H-1B Extension with the same employer.
My last H-1B was in 2007. I looked on doleta.gov The Prevailing Wage
in 2007 for the same job and same location as I am right now at
Level 3 was 57000.00, Now in 2010 it is 76000.
I talked to my Employer about this, he says he cannot raise my salary that much.
My Question is
1. When I applied for Foreign Labor Cert On-line does the
Prevailing Wage has to be most recent even in case of H-1B Extension ?
2. Is is ok If I go to Level-2 Instead of Level-3, will it considered as
change in Employment ?
3. The Prevailing Wage for 2008 for the same job and same location
as I am right now at is 66000. Should I Try to Apply for labor
cert referencing 2008 Prevailing Wage. ?
4. What are my options ?
