    I have applied for labor certification in Dec 2006. In may 2007 I got a denail stating that the company is not "bonafide". It is a new company and I am the 1st applicant for labor. We sent all the supporting documents and requested for review/appleal in May 2007. Since then we did not get any status from them. My attorney called them last week and made an inquiry. DOL Atlanta said that they need to do the "central check" of teh company. They do this for every new company. Does anybody aware of this "central check". How long it will take?

    per existing policies and procedures, requests for Premium Processing Service will continue to be processed within 15 days. USCIS wishes to assure all customers that the original received date (the date which the document is date stamped) will be honored and recorded on the receipt notice. This date will appear in the "Received Date" box on Form I-797, Notice of Action. The received date is different from the "Notice Date", which also appears on Form I-797. The Notice Date is the date the receipt notice was actually generated.



    Why USCIS suddenly did this press release? Something fishy?

    I do not believe the 800,000 figure for I-485 alone. It could be a misquote from Aytes. The 800,000 is possibly combination of all immigration related applications such as I-140, 485, 131, 765, etc.

    Even during last year when EBs are current, it didn't reach that many applications. I believe Matthew OH is more accurate in saying there's a total of 320,000 I-485 applications.

    With that figure, average 2.5 years waiting is in order. But that should not be distributed equally among all countries due to per country limit. I would guess, for India and China, it would be 3 years wait, and for the rest, 2 years.

    Why USCIS suddenly did this press release? Something fishy?

    Generally they give this update on last week of every month.

    When you get the letter ready we'll send it again. It doesn't hurt to send them the letters 100 times.
    I believe in 1 thing.... Is the media(in this case letter) imparting the message ? If the answer is 'Yes', we are done!!!!
    Trust me my friend, spellings commas and fullstops doesn't matter...If you need to send out a message send it ASAP...
    mirage, I am not trying to turn down this effort. In Fact, I have sent at least 50 letters as part of IV campaigns and I have written so many on my own. All I was saying that we need a professional letter that will have better impact. Once we have the letter ready, I will be the first one to send it out.

    I have talked to a representative and he very patiently explained me about the mess.
    He clearly and very clearly told me that they have a deadline to send all receipts for June end and July 2nd filers by friday (tomorrow) or worst case monday.

    He mentioned that they are working hard to meet this deadline.
    Hope this clears the anxiety.

    Progress at the Backlog Elimination Centers (�BEC�)

    William Carlson, Administrator of the Office of Foreign Labor Certification, said that the BEC is on target for meeting its goal to clear up the backlog of Traditional and RIR cases by September 30, 2007. The BEC started with 365,000 cases that were filed prior to PERM. As of December 2006, 220,000 have been closed out and 142,000 are still pending. Of the pending cases, 59% are Traditional Applications and 41% are RIR Applications.

    USCIS can process recaptured numbers. If 200k numbers are in one year USCIS will plan for 200k numbers in that year.In 2000 they processed more applications after a immigration reform. One way of preventing wastage is plan to process all the applications in 11 months. If any unused numbers can be processed in that one month.

    and by your usual logic, why can't they plan for 140,000 every year? they know in advance don't they? there has been a year in which almost half the green cards were wasted- look it up yourself- the fact remains that they waste every year and it is useless to expect that they will suddenly and consistently do much more than is being asked now. unless...something changes...

    just for my info do you find anything at all wrong with the whole process? or are we just misguided fools that you are here to educate?

    the numbers may be exaggerated, but it doesnot change the facts..
    even if we agree that its going to be 500k with 15-20% of them being indians, we still have a long wait ahead of us.

    Rather than fighting among ourselves, we should channel our frustration/anger towards the fight for :
    adding back unused visa numbers,
    increase in GC numbers.

    We can express our support to Senator Lofgren or whoever is leading this effort.

    While we enjoy the interim benefits, our fight for permanent solution should not be obscured by it.

    I totally agree with you on this. But I am not talking about the MTR. I am talking about the fee issues. Why do we need to pay if its their mistake. I dont think we are talking about the fee waiver with congress men's office or anyone else.

    I agree. We definitely need to get some kind of process to correct "service errors" against filing MTR which is associated with a cost.

    Remember MTR is basically for presenting NEW FACTS and not to correct service errors.

    If members can come up with innovative ideas of correcting these issues, we can definitely do campaigns.

    All we need is cooperation and help from members.

    AC21 denials is clearly a service error and when one invokes AC21 the person should not be punished by slapping a denial and making him/her accrue unlawful status and forcing them to open a Motion.

    What was the result of second MTR, Is that dismissed too...

    My PD is March-2003 and I didn't get the labor cleared till Late 2006

    I just can't help wondering how did you get your labor in 2004 with the PD of May-2003? How come snake of BEC didn't bite you? :)

    Not everyone from 2003 landed in the BECs. In those days, the processing time depended a lot on the state where the labor was filed from (and also on whether the case was filed in the RIR track, or the Non RIR track). My PD was Aug 2003 in the Non RIR track in MA. A friend of mine had a PD of May 2003 in the RIR track, also from MA. His labor was cleared in early 2004 before the BEC hell began. I got stuck in BEC. As luck would have it, retrogression struck and now we are both in the same boat!

    Came to US in 2000 Labor filed 2002 Jan 31st in EB-3........took 4 yrs to clear labor from Dallas backlog center...I-140 approved in 2007 and filed I-485....

    Still counting days...........gave up actually....USCIS will probably start VIBYORG instead of
    VIBGYOR

    First :Violet card
    Second: Indigo card
    Third: Blue card
    Fourth: Yellow card
    Fifth: Orange card
    Sixth: Red card
    Seventh: Green card
