What if out of all 10000 , 9999 don't have priority date current.Do you think they will still not look at the 1 in the pile which has a current PD.They will look at it , Even if it is number 10000 in the list.Actually there will be no pile because 9999 people won't even be in contention.
Why do you think labour substitution was so HOT?Just because by getting an earlier PD , you were going to steam roll everybody who filed before you , just because you got an earlier PD..
In your case you will get the percedence over the 2001 PD. His is PD is not curent at time of processing. If the cut off date is after 2002 which means both are cuurent then the later guy will take precedence since his RD is earlier than your's.

Hi Folks-
We (5 People) work for IBM company, SFO, today we went personally to the congress men and we submit the letter which is provided in this forum and after that we called state senator office and we explained about our problem. We faxed and email the letter to the senator office, staff had taken my contact details and they told me that they will inform the solution in 2days.

Guys don’t presume you don’t have rights for this and that. late in spring of 2005 I had a meeting with my state’s senator and he took all my details and wrote to Backlog Center in Philadelphia. After 2 months his office called me and send me the correspondence they got from BEC. They had description about my file etc. my labor was cleared in a month after that. Apparently BECs informed his office about the approval too, and to my surprize they called me up again and told me the news. They are public office they are answerable to us, we need to ask…

You can't even vote. You can't even just change employers without hassle. You can't even just leave the country and come without proper documents. You can't even apply for a student loan. You can be deported any time you have a problem. You can't even renew your driver's license without showin proof of proper residency.
Even with GC your rights are still not as good as a US citizen.
Yes we do have rights.
But the government is only answerable to a certain level. You cannot ask for information of the internal workings of a government. That's not going to happen.

The reason CIS isnt processing EB3 for last 3 months is because the dates are U and since they have lot of pressure not to waste visa numbers they have put all resources into EB2.
I have seen EB2 cases filed in May-08 been approved.
But i know this is unfair for EB3 people like us waiting for over a yr.

No, this is only the processing time for labor application, the whole process took a lot longer than this. I first submitted my document to the lawyer in the last week of January this year. Lawyer prepared my case, wages approval etc. it took around 1+ month to get preventing wages. then advertisement, recruitment process etc.
almost 8 month to finish all the requirements before the company could actually file the labor application.

Kudos to USCIS though for keeping themselves employed. They have made such a mess of what could be a simple immigration planning process, by introducing layers upon layers of groupings, arbitrary allocation number limits and what not. A similar but perhaps even more complicated rocket science mess exists in another govt entity - the IRS.
