hi
we are paying social security and medicare taxes where as we are not entitle to any of this benefits. they are taking this taxes based on giving permanent status but they have slowed green card processing near to impossible. that's fine, but taking social security taxes is not right when we are certainly not going to part of that system.
they must stop those taxes till green card is processed.

I believe some lawyers still do 245(i). The fee is $1k. Talk to an immigration lawyer or google "245 (i)"

I am currently in INDIA and applying for my H1. I have a couple of questions regarding this:
Back Ground:
1. My husband and myself are applying for H1 B.
2. Company A is sponsoring H1 for my husband and company B is applying for H1 for me.
Q & A:
1. As H1 B is lottery system this time too, we both are applying for H1. Is it possible that, if both of us get H1's, can I still enter into US on H4 status and later convert to H1.

My current h-1 B visa in passport expires May 1, 2007. And I have a I-94 valid till May 1, 2007. I already got 3 yr h-1 b extension valid from May 2, 2007. I have to travel to canada in March and I am planning to get the new H-1B visa stamping when I am there instead of making another trip.
Is it possible to go for visa stamping for the extension h-1b, when the intial
H-1B visa is still valid. My understanding is if the visa is issued, all the previous visas will be cancelled. In that case, Can I re-enter US in March with a H-1B valid only from May, 2007

USCIS reports that 1000 H-1Bs were receipted over the past week with 34,500 now counted. 400 masters cap cases were added bringing the total to 13,000 in that category. Can someone get GC’s without reaching the priority dates?
I don’t have much information but I heard the following by mouth. My friend told me that he came to know a person(Indian) who had got his GC without the priority date being current. His prior status was EAD. If it is real, is this a fluke case?
I know many people applied for I485 in 2005 Sep, and PD was also from that year, and got the EAD’s. So do they have priority of getting GC than people who had PD dates prior to 2005 but not filed for I485?

hello, i really need some one to clarify this information for me.
when i first started working with my company i did not have work authorization and basically said i am a US citizen, i never had any problems for 4 years, i am a permanent residence now and got my green card this year. the company now nows that i lied 4 years ago when i got hired and i was not allowed to work but am fully eligible to work now becaue of change in status to PR. can the company resubmit a new i9 form with the correct information and if i will be in any trouble with USCIS.
What is the law for someone who worked illegaly but got his or her status changed to PR.

I am on H1B , This is my 5 th year in US on H1B . My Initial Visa Stamping got expired . I changed from company A ( visa stamped ) to Company B, Currently I am H1B Extension ( I797 ) with out Visa . My wife and kids are with me on H4 (same as my case , old Visa expired now on extension of H4). They want to travel to India this summer . They need a Re entry Visa .
My Questions

IV Team,
I'd filed my concurrent EB2 I140+I485 on Aug 17, 2007 at the Texas Service Center. I have been trying to check the status of my I140 petition online for the last 3-4 months. Every time i try to do so, i get the following error message:
"Case Status Retrieval Failed. This Receipt Number cannot be found at this time in this automated system"
Am I the only one with this problem ? or are there others experiencing the same issue ?

contact the following people and ask what you need to do to file taxes:
1. contact employer
2. contact your payroll company (like adp, etc) that process your company's payroll
3. contact IRS helpline or customer service (including local or state tax dept)
4. contact experienced tax consultant (CPAs)
I thought employer should have arranged for duplicate one. if not contact above all people and find out what you can do about it.

i am in a small problem and it would be great if someone could help me out.
i came in us on f1 visa in jan2008 and i completed my mba in dec 2010. my opt expired on 31st march 2010. but before my SEVIS could expire i transfered my SEVIES to new college for summer term. now my visa is for 5 years ending on jan 2013. i know as long as i stay in US i am maintaining my status. but now i need to go home for few days. So how is it going to wrok for me? Do i need to go for new visa stamping or can i come back on same visa ? if i need to get new visa can i get it done in US before going home ? What are my option and what are my chances of coming back?
