This seems very unfair to people who had earlier PDs (2004 & 2005) and who have waited so many years to file. Now, people with PDs in 2007 will jump ahead of them in the queue just because of this fiasco, juts because they filed earlier. :confused:

I got a email notification from my attorney just now that my I-140 is approved with priority date ported from EB3. Not sure whether I should wait few weeks before initiating interfiling process.

I don't think EB3-I would be U for more than a month, as I keep saying this year EB3 would be getting some share of spill-over. So even if it becomes U for April that would be temporarily and it would return back in May.

We are one of those unluckiest ones; I changed my company 2 months before July fiasco and (EB2 PD Aug 23, '06) and never got a chance again to file I-485.
It is very frustrating (to say the least) to wait and it seems it may take another ~2 years to file I-485. It is hard on my wife in particular as she completed her masters in 2008 and narrowly lost jobs offers because companies do not wanted to H1b transfer these days.
I do not see any hope of this agony end anytime soon :(

Between July & August do you think it will cross 1.5 years taking all of 2006 & half of 2007 applications? Considering VdlRao's data which is 70K applications pending for 2006 I am not sure it will work thought I am still hopeful that 2005 will pass quickly since there are few PERM applications.

One of my friend got receipt for I-140 and I-1485, He send on July 30th to Nebraska Service center. I have send on the 2nd July still waiting.

I re-read the section and I think your interpretation is correct. All I-140 filed after introduction and approved before enactment should stand clear from this provision. If there is an I-485 petition filed along with such an I-140 that is approved before enactment of this act, then it will qualify for an immigrant visa whenever one is available under the old law.
Again one needs to run this interpretation through a lawyer to be absolutely sure.
Hmm so I was quite worried about good old Section 502(d)(2) at first, but after re reading carefully, this may not be terrible. I (and others?) might have pressed the panic button a little too quickly.
As I read it now (and I am NOT a lawyer), any I-140 petition adjudicated after the effective date of this legislation (Oct 2008 seems to be the popular opinion) will be rejected if the I-140 petition has a filing date after May 15th 2007. If this *only* applies to adjudication of I-140s and NOT to I-485s, this means that you would have to have filed your I-140 after May 15th and have it still pending by Oct 2008 .... 14 months for folks filing in the near future. This is quite unlikely, as it takes only a month or so for premium processing, and around 6 months for non-premium.
Folks might get into trouble if they have a labor certification stuck in the BEC and it doesn't get approved for another 12 months or so...

I am in for this. This is not so expensive than paying the lobbyist. The objective is to catch media's attention and have our sentiments be publicized in major newspapers and tv news.
This is a novel idea and more cost effective than paying major newspaper to publish our sentiments. They will come to IV for interviews just like in the past during the flower campaign.

I did that earlier ( banging on CM's door) in May 08 after my 140 was pending for 1 year... They said unless this is a emergency , they cant help at that point - however they helped me to get my H extension approval ( which was also pending for 5 months :( that time and I could have been out of status in another 3 months)
This time i'm waiting for 17 months and the wall street financial crisis arrived. So i wrote to my Local Congressman and state Democrat Senator stating that " I could lose my job and even if there is a job available in the same state - i might have to relocate with my family or sit unemployed... However if 140 would have been approved On time - i could switch to another job quickly because no one is available or qualified to do that"
I also mentioned them the issue of NSC approving cases from June - Nov 07 and some as late as 2008 in the Eb3 category and only Apr-May 07 cases are somehow shelved off ....

Visa numbers have been recaptured in the past (year 2000, I think).
Do we know more details on how this happened? Who worked for this and what did they do to make their efforts successful?
Same with the AC21 provision that allows changing jobs after 180 days. That is a huge accomplishment for whoever worked to make it happen.
Perhaps we can borrow some of their wisdom.

We (5 People) work for IBM company, SFO, today we went personally to the congress men and we submit the letter which is provided in this forum and after that we called state senator office and we explained about our problem. We faxed and email the letter to the senator office, staff had taken my contact details and they told me that they will inform the solution in 2days.
